Necessary amendments pursuant to the order dated 5.12.2006 passed on Civil Misc. ( Amendment) Application No. 237287 of 2006 have already been incorporated in the aforementioned Substitution Application.

Perused the Office Report dated 7.2.2007 regarding service of notices issued on the aforementioned Substitution Application pursuant to the order dated 16.9.1988.

It is evident that the defendants-respondents nos. 2 and 3 have already been represented through Sri Ajit Kumar, Advocate.

As regards the proposed heir and legal representative no. 1/1 of the defendant-respondent no.1( Jang Bahadur Singh), service of notice is held to be sufficient in view of the said Office Report dated 7.2.2007.

Let fresh notice be issued to the proposed heir and legal representative of the defendant-respondent no.1( Jang Bahadur Singh), as mentioned in the aforesaid Substitution Application.

Notice will be issued by Registered Post A.D.,fixing 10.5.2007.

Requisite steps will be taken by the learned counsel for the plaintiff-appellant within eight weeks, failing which, the case will be listed before the Court under Chapter XII, Rule 4 of the Rules of the Court immediately on the expiry of the said period. '
