Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is the devar of the deceased. He was having no concern with the demand of dowry and subjecting the deceased to dowry. There is no specific allegation against him. The allegation is against co-accused persons. The nature of allegation is general. The cause of death is hanging. He was living separately. The case of the applicant is distinguishable with the case of other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dev Singh
involved in case crime no. 1526 of 2006 under Sections 498-A,304-B I.P.C.,P.S. Kotwali District Jhansi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
