Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that there is a cross version of the alleged incident. From both side F.I.R. have been registered. Both side have received injuries. From the side of the applicant one person lost the life and two persons sustained injuries and from the side of the applicants seven person sustained injuries. The injuries sustained by the applicants side have not been explained by the prosecution. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Siraj, Hafij, Murtaza, Nasir and Rashid Sekh involved in case crime no. 711A of 2006 under Sections 304,308 I.P.C., P.S. Gopiganj District S.R. Nagar Bhadohi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
