On 5th February, 2007 also, the learned counsel for the defendants-appellants was not present, even when the case was taken up in the revised list.
In the circumstances, there is no option, but to dismiss Civil Misc. (Substitution) Application No. 4700 of 1992 (Dated 28-10-1992), which is up for consideration today, for want of prosecution.
Accordingly, Civil Misc. (Substitution) Application No. 4700 of 1992 (Dated 28-10-1992) is dismissed for want of prosecution.
It may be mentioned that the aforementioned Substitution Application was filed consequent to the death of Ram Pal Singh (plaintiff-respondent No. 2).
In view of the dismissal of the aforementioned Substitution Application for want of prosecution, the Second Appeal as against the said Ram Pal Singh (plaintiff-respondent No. 2) stands abated.
This fact will be brought to the notice of the Court at the time of hearing of the Second Appeal.
