It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but after two months of the alleged occurrence the name of the applicant has been disclosed by the first informant after two months of the alleged incident on the basis of doubt and suspicion. The evidence of last seen has been collected by the I.O. against the applicant. There is no other evidence against them.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Kaplu involved in case crime no. 425 of 2006 under Sections 302,201I.P.C., P.S. Saraimir District Azamgarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
