Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was not named in the F.I.R.given by the first informant but subsequently he was named in the F.I.R. dated 20.8.2006 at about 8.10. p.m. in respect of the incident which had occurred on 8.7.2006. The allegation against the applicant is that the deceased was seen in the company of the applicant. There is no direct eye witness account. During investigation the allegation has been made against the co-accused who has made extra judicial confession and at his pointing out skeleton of the deceased was recovered.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Prabal Pratap alias Guddu involved in case crime no. 199 of 2006 under Sections 363,302 and 201 I.P.C. P.S. Ajitmal District Auraiya be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
