Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the record.
There is specific allegation for demand of dowry and causing death to the deceased Sunita against the petitioners in the impugned FIR. A perusal of the post mortem examination report (Annexure 2) would indicate that the victim died due to asphyxia as a result of smothering. There appears no justification to interfere in the impugned FIR, therefore, we are not inclined to do so.
However, in the event the petitioners put in their appearance or are produced before the court below and make an application for their release on bail in Case Crime no. 500 of 2006 under Section 498A/304B IPC and ¾ D.P. Act P.S. Ujhani, District Budaun, the same shall be heard and disposed of expeditiously in accordance with law.
The petition stands disposed of accordingly.
