Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case NCR has been lodged alleging therein that four persons including the applicant caused injury on the person of the deceased by using lathi danda blows. According to the medical examination report the deceased has received only three injuries caused by hard and blunt object. According to the post mortem examination report the deceased died due to head injury but it has not been specified as to who caused head injury.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Babu Lal involved in case crime no. 230 of 2006 under Sections 304 and 504 I.P.C., P.S. Pilkhua Hapur District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
