This appeal has been filed by Ram Chet, Bechan Prasad, Ram Lutawan, Ram Bahor, Ram Deo and Ram Lal against the judgement and order dated 01.2.2007 passed by special Judge, SC/ST Act, Basti in S. T. No. 79 of 1996 whereby the appellants have been found guilty and convicted under Sections 147, 323/149, 308/149 IPC. Appellants Ram Chet, Bechan Prasad, Ram Lutawan and Ram Bahor have been sentenced to undergo rigorous imprisonment up to four years and other two appellants have been sentenced to under rigorous imprisonment up to three years.

Heard learned counsel for the appellants, learned A.G.A. and perused the record.

Learned counsel for the appellants has contended that it is a cross case and injuries were also received on the side of the appellants. He has further contended that no X ray report was produced by the prosecution and in the cross case accused have been acquitted.

Considering the facts and circumstances of the case but without prejudice to the merits of the case, appellants be released on bail during the pendency of the appeal on their furnishing a personal bond with two sureties each of like amount to the satisfaction of the Court concerned.

They shall also give an undertaking that they will not indulge in any criminal or antisocial activity and if any report is found against them, it shall be open for the court below to report to this court so that their bail may be cancelled.
