Heard learned counsel for the applicant and the learned A.G.A. and Sri Anoop Singh, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that there is specific allegation of causing injury to the deceased against the co-accused Harish. The applicant is the mother in law of the deceased. She was living separately along with her eldest son at Aligarh. The father in law of the deceased has been released on bail by the learned Sessions Judge. The case of the applicant is distinguishable with the case of the husband of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Kunti involved in case crime no. 169 of 2006 under Sections 498-A/304-B I.P.C., and ¾ D.P.Act P.S. Debai District Bulandshahar be released on bail on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
