This appeal has been filed by Sanjay Singh, Tejpal Singh, Phoolwati, Naresh and Brahmwati against the judgement and order dated 3.2.2007 passed by Addl. Sessions Judge, Court No. 6, Bijnor in S. T. No. 601 of 2004 whereby the appellants have been found guilty and convicted under Sections 498-A, 307/34 IPC and Section 3/4 D.P.Act and have been sentenced to undergo rigorous imprisonment up to seven years. Fine has also been imposed on them with default stipulation.
Heard learned counsel for the appellants, learned A.G.A. and perused the record.
Learned counsel for the appellants has contended that in this case parties have entered into compromise and even the victim the wife of the appellant Sanjay Singh did not support the prosecution case in her cross examination. He has further contended that there is every likelihood that the husband and wife living together in case the appellants are released on bail in this appeal.
Considering the facts and circumstances of the case but without prejudice to the merits of the case, appellants be released on bail during the pendency of the appeal on their furnishing a personal bond with two sureties each of like amount to the satisfaction of the Court concerned and also on depositing Rs. 6000/- as fine out of the total amount of fine as imposed on them and the balance amount of fine shall remain stayed during pendency of this appeal. The fine so deposited shall be paid to the victim as directed by the learned Trial Court.
