Smt. Gayatri Devi v. State Of U.P. Thru' Nideshak Bal Vikas Sewa Evam P. & Ors. - WRIT - A No. 7723 of 2007 RD-AH 2379 (13 February 2007)
Court No. 38
Civil Misc. Writ Petition No. 7723 of 2006
Smt. Gayatri Devi
State of U.P and others
Petitioner applied for consideration of her candidature as Aanganbari Karyakatri. Petitioner was selected by virtue of belonging from below poverty line category. Subsequent to the same, complaints were made, that income certificate of the petitioner is based on totally false and incorrect facts. Inquiry was got conducted and in the said inquiry it has been accepted by the petitioner that husband of the petitioner is running a medical store and further her father in law is Ex-Principal. On the basis of inquiry made as income certificate of the petitioner was based on totally incorrect facts the appointment of the petitioner has been cancelled.
In the entire body of the writ petition there is no challenge to the fact that husband of the petitioner owns medical store and thus, this admission on the part of the petitioner that her husband owns medical store, clearly substantiates that she does not belong to below poverty line category. Cogent reason has been given by the District Magistrate for cancelling the candidature of the petitioner. Once valid reasons are there and appointment has been offered to the petitioner on the basis of incorrect certificate, as such there is no occasion to interfere with the said finding of fact.
Consequently writ petition lacks substance and is dismissed.
