Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is Jethani of the deceased. The marriage of the deceased was solemnized six years prior the alleged incident. The applicant was living separately. She was having no concern with the demand of dowry and subjecting the deceased to cruelty. There is no specific allegation against the applicant. The allegations are general in nature. The case of the applicant is distinguishable with the case of the husband of the deceased. The co-accused Kusuma has been released on bail by this court on 5.12.2006 in criminal misc. bail application no.26541 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Smt Geeta Devi involved in case crime no. 80 of 2006 under Sections 498-A,304-B I.P.C., and ¾ D.P.Act P.S. Surir District Mathura be released on bail on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
