Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the role of catching hold is assigned to the applicant whereas the role of causing injury is assigned to the co-accused Sonu Singh
In reply to the above contention it is submitted by the learned A.G.A. and the learned counsel for the complainant that the applicant has been convicted for the offence punishable under section 304 I.P.C. against which he has filed criminal appeal which is pending in which he has been released on bial.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dinanath Singh involved in case crime no. 750 of 2006 under Sections 302 I.P.C.,P.S. Chiluatal District Gorakhpur be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the condition that the applicant shall not tamper with the evidence and he shall report to the court of C.J.M. concerned in the first week of each month till conclusion of the trial to show his good behaviour.
In default of the above condition the bail granted him shall be deemed cancelled and he shall be taken into custody by the learned C.J.M. concerned
