  Heard learned counsel for the applicant and the learned A.G.A.

        It is submitted by learned counsel for the applicant that according to the prosecution version 8 or 10 miscreants discharged shots consequently one person received injury. According to the post mortem examination report the deceased has received one firearm wound of entry. It has not been specified whose shot hit the deceased. The co-accused Sonu Prasher has been released on bail by another bench of this court on 7.10.2006 in criminal misc. bail application no. 10588 of 2006 and the co-accused Raju has been released on bail by this court on 1.11.2006 in criminal misc. bail application no. 22772 of 2006.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.

Let the applicant Ram Vir Singh  involved in case crime no. 106  of 2005  under Sections 147,148,149, 307 and 302     I.P.C.,     P.S.  Jasrana  District   Firozabad be released on bail on his furnishing a personal bond and two  sureties  to the satisfaction of the Court concerned on the following condition :

1)given report at the concerned police station on every Sunday at the time fixed by the in charge of the concerned police station.

2)He will not tamper the evidence.

3)He will not leave the district Firozabad without the prior permission of the C.J.M. Firozabad.

4)He shall co-operate with the trial in default it shall be open to the learned C.J.M. Concerned to cancel the bail application of the applicant.
