Heard learned counsel for the petitioners as well as learned Standing Counsel appearing for the respondents. Pleadings have been exchanged and with consent of the learned counsel for the parties, this writ petition is being disposed of at this stage.
The petitioners are all students of the High School and Intermediate of Shanker Inter College, Machkheda, district Moradabad. The submission is that earlier their institution was an examination centre but this year the said institution has not been made an examination centre. The submission of the learned counsel for the petitioners is that the nearby colleges which have been recognized as examination centres are at a distance of 11 to 23 Kms., the details of which have been given in paragraph 7 of the writ petition. The submission is that since the petitioners are all residents of villages, it would not be possible for them to go to the examination centre at such a great distance for giving examination, which starts early in the morning. In paragraph 9 of the writ petition details of certain colleges have been given which are duly recognized by the respondent-Board but are not being made examination centres. The petitioners do not say that any particular college be declared as an examination centre but their only prayer is that because of distance factor anyone of the colleges of the vicinity be declared as an examination centre for the petitioners and other students of Shanker Inter College, Machkheda, district Moradabad. It has also been submitted that no examination centre has yet been allotted to the petitioner and other students of the Shanker Inter College. It has further been submitted that under Chapter VI of the Regulations framed under the U.P. Intermediate Education Act, 1921 the Secretary of the Board would be competent officer to look into the grievances of the petitioners.
In the aforesaid circumstances, it is directed that in case the petitioners file a comprehensive representation before the respondent no. 4, the Secretary, Board of High School and Intermediate Education, Allahabad alongwith a certified copy of this order, the said authority shall either allot examination centre in the vicinity of the Shanker Inter College or if the same is not done, the said authority shall pass a reasoned and speaking order within two weeks from the date of filing of such representation.
With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to costs.
