Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has been put up for identification. It is alleged that the applicant was apprehended by the police. From the possession of the applicant Rs. 1 lac was recovered. The recovered currency notes were not bearing specific marks to connect the same with the looted currency notes. The co-accused Man Mohan, who was also apprehended by the police has been released on bail by this court on 22.12.2006 in criminal misc. bail application no.28372 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Arvind Kumar involved in case crime no. 585 of 2006 under Sections 396,412 I.P.C., P.S. Kotwali District Mathura be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
