Sri Vivek Verma, learned counsel appearing for respondent No.2 has raised a preliminary objection regarding the maintainability of the writ petition contending that for the same cause of action earlier Writ Petition No. 49042 of 2006 is pending and second writ petition is not maintainable for challenging the consequential order.

In view of the above, Sri G. B. Singh, learned counsel for the petitioner prays for and is permitted to withdraw the petition.

The writ petition is dismissed as withdrawn.
