Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that applicant no.2 is Nanad of the deceased and applicant no.1 is the husband of applicant no.2. They are living separately. They are having no concern with the demand of dowry and subjecting the deceased to cruelty. According to the prosecution version the marriage was solemnized about three and half year prior the alleged occurrence. The case of the applicants is distinguishable with the case of other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Vinod Rai and Smt. Mamta Rai involved in case crime no. 1411 of 2006 under Sections 498-A,304-B I.P.C., and ¾ of D.P. Act P.S. Kotwali District Jhansi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
