This application has been filed by the applicants Brijesh, Smt. Chetan Devi, Prema,Prabhu, Akhilesh, Gita, Vinita, Plkhpal, Rajpal, Room Singh and Smt. Sukh Devi with a prayer to quash the criminal complaint Case No. 1390 of 2006 under sections 494/109 I.P.C. pending in the court of Judicial Magistrate, Court Kasganj.
From the perusal of the impugned order dated 17.6.2006, it appears that the learned Magistrate has taken cognizance to summon the applicants to face the trial.
There is no illegality or irregularity in the impugned order. Therefore, the prayer for quashing the impugned order is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicants it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail their bail application shall be considered and disposed of on the same day. No coercive steps shall be taken against the applicants for a period of 30 days from today.
With the above direction the application is finally disposed of.
