Having examined the First Information Report where both the petitioners are named accused and there is only one more unnamed accused. The allegation is that the wife of Raju Gautam namely Maju Devi was beaten up badly because of which she underwent an abortion. She is alleged to have been treated at Government Hospital at Kanpur. At present, there is no reason to suspect false implication inasmuch as, there does not appear to be any unnecessarily large scale implication of accused. Therefore, there is no good ground for quashing the First Information Report or staying the arrest.
However, if the petitioner surrenders and apply for bail in case crime No. 14 of 2007 under sections 323/504/506/324/452/312 I.P.C. P.S. Panki district Kanpur Nagar, their bail application will be considered and disposed of by both the Courts below expeditiously.
The writ petition is disposed of as above.
