The contention of the petitioner is that a pathway is being laid not at the place meant for the Chuk road but at some other place. This is a highly disputed question of fact which cannot be determined under Article 226 of the Constitution as evidence would necessarily be required to be taken in such matters.

We, therefore, decline to entertain this petition under Article 226 of the Constitution and, accordingly, dismiss it.
