Heard learned counsel for the applicants and learned A.G.A.
It is contended by the learned counsel for the applicant that non bailable warrant has been issued against him in Criminal Case No. 832 of 2005 under sections 218 I.P.C. P.S. Turuk Patti district Kushinagar.
From the perusal of the record, it appears that due to non appearance of the applicant before the court concerned, learned Additional Civil Judge(J.D)/ Judicial Magistrate, Kasiya has issued non bailable warrant against the applicant There is no illegality in issuing the non bailable warrant. Therefore, the prayer for quashing the order dated 91.2007 is refused.
Considering the facts, circumstances of the case and the submissions made by the learned counsel for the applicant and the learned A.G.A., iit is directed that in case the applicant appears before the court concerned within 30 days from today and apply for bail, the same shall be considered and disposed of on the same day in accordance with the provisions of law. No coercive steps shall be taken against the applicant for a period of 30 days from today.
With this direction, the application is finally disposed of.
