Heard learned counsel for the applicant and learned A.G.A.
It is contented by the learned counsel for the applicant that the accused persons are not appearing before the court of learned Additional C.J.M.,Agra in case no. 1530 of 2-007 under section 364 I.P.C. P.S. Sadar Bazar district Agra.
It is further contended that the matter is of grave in nature, due to non appearance of the accused persons the case is not committed to the court of sessions.
Considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and the learned A.G.A. It is directed that the committal court shall adopt coercive measures to ensure the appearance of the accused persons.
With the above direction the application is finally disposed of.
