Accused applicant Madan Lal and Puran Lal sons of Bhola Nath have prayed for release on bail in Case Crime No. 900 of 2006,, under Section 329 IPC, P.S. Bilsanda, District Pilibhit.
Heard learned counsel for the parties and perused the material on record.
Supplementary affidavit filed by the applicant be taken on record.
Learned counsel for the applicants has contended that in the first information report three persons were alleged to have fired at the informant but in his statement under Section 161 Cr.P.C., the informant has stated that the accused applicant Pooran Lal exhorted and Madan fired at him.
Learned counsel for the applicants has also contended that the fire allegedly hit the injured on his hip region and the injury was not found to be grievous. He has further contended that the applicants have been falsely implicated in order to take their property.
In the circumstances of the case, appellant is entitled to bail.
Let the applicants involved in above noted case crime be released on bail on their furnishing personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
They shall also give an undertaking before the court concerned that they will not indulge in any criminal or antisocial activity and will not cause either any direct or indirect threat or any physical violence to the complainant and the witnesses and their family members and shall also not tamper with the evidence. If any such report is made by any of the above person either to the Court or the police, it shall be properly inquired into and if any substance thee is found, it shall be open for the Court below to report to this Court so that their bail may be cancelled.
