Vijay Bahadur Singh died in harness on 07.05.2001. Petitioner is undisputedly divorced daughter of late Vijay Bahadur Singh. On 01.05.2006 application was moved for grant of compassionate appointment. Divorce decree has been passed on 06.11.2006. Petitioner's claim for grant of compassionate appointment has been rejected.
Factual position which is emerging is to the effect that at the point of time when Vijay Bahadur Singh died in harness, petitioner was not at all divorce lady and divorce decree has been passed on 06.11.2006. Claim of the petitioner could not have been considered being married daughter, as such the ground on which District Basic Education Officer, respondent no. 2 has rejected the claim of the petitioner cannot said to be unsustainable ground. Even otherwise in the present case decree of divorce, prima facie , appears to be procured one only the for the purposes of procuring compassionate appointment.
Consequently, no relief can be accorded to the petitioner, writ petition lacks substance and dismissed.
