Criminal Misc. Bail Application No. 2160 of 2007 has been filed by Deepak S/oSri Prahlad Kishor Gupta and Criminal Misc. Bail Application No. 3424 of 2007 has been filed Sagar son of Late Prahlad Sharma for release on bail in case Crime No. 22 of 2007 under Section 467, 468, 420, 471 IPC, P.S. Civil Line, Moradabad, District Moradabad.

Since these two applications arise out of the same case crime, they are being heard and decided together.

Sri A. N. Tripathi has filed parcha on behalf of applicant Deepak, keep it on record.

Heard learned counsel for the parties and perused the material on record.

Learned counsel for the applicants has contended that in this case main allegations are against co accused Bichitra Mohan Sharma, who has already been directed to be released on bail by order dated 13.2.2007 passed by another bench of this Court. Accused persons were arrested from the house of accused Deepak and they were found using and preparing forged Insurance papers. They were taken there by the co accused Bichitra Mohan Sharma who was also found in possession of forged papers and other materials.

Considering the facts and circumstances of the case and the fact that Bichitra Mohan Sharma has been directed to be released on bail, applicant is entitled to bail.

Let the applicant involved in above noted case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.

He shall also give an undertaking before the court concerned that he will not indulge in any criminal or antisocial activity; will not cause either any direct or indirect threat or any physical violence to the complainant and the witnesses and their family members and shall also not tamper with the evidence. If any such report is made by any of the above person either to the Court or the police, it shall be properly inquired into and if any substance therein is found, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
