Heard learned counsel for the applicants and learned A.G.A.
This application has been filed by the applicants Smt. Dulari Devi, Km. Gudiya , Kishan Lal and Tinchu against the order dated 7.10.2006 passed by the Judicial Magistrate First, Agra whereby the learned Magistrate has taken cognizance and summoned the applicants to face the trial for the offences punishable under sections 498-A,506 I.P.C. and ¾ D.P. Act
From the perusal of the record i appears that the order impugned is not suffering from any illegality or irregularity. Therefore, the prayer for quashing the same is refused.
Considering the facts and circumstances of the case it is directed that applicant nos 1,3 and 4 shall appear before the court concerned within 30 days from today and apply for bail, the same shall be considered and disposed of on the same day in accordance with the provisions of law. For a period of 30 days from today no coercive measures shall be taken against them.
So far as applicant no.2 is concerned, she shall not be arrested till the framing of the charges. Her personal appearance shall be noted through her counsel.
With this direction this application is finally disposed of.
