Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. on the basis of the disclosure of his name by the co-accused Ram Shanker joshi. No looted property has been recovered form the possession of the applicant. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Suresh alias Fauji involved in case crime no. 205 of 2006 under Sections 394,302,120-B,201 and 41/412 I.P.C.,P.S. Darapur District Kanapur Dehat be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
