Heard counsel for the petitioner and the learned standing counsel.   No notice is being issued  is being issued to the respondent no. 3 in view of the order which is being passed.

By this writ petition,  the petitioner has prayed for quashing the  recovery citation dated 16.1.2007 sent  by the Deputy Labour Commissioner to the Collector, Jalaun for recovering Rs. 20,000/- as compensation under the Child Labour ( Prohibition and Regulation) Act, 1986.  Learned counsel for the petitioner contended that no notice  was served to the petitioner and the notice dated 12.12.2006 referred to in the  recovery certificate was never served on the petitioner.

In view of the facts and circumstances of the present case  and the submission made no useful purpose will be served in keeping the writ petition pending.  Ends of justice will be served in permitting the petitioner to file detailed reply  before the respondent no. 2 within one month from today which may be considered and disposed of  by the Deputy Labour Commissioner within a further period of two months. Till the decision is taken by the Deputy Labour Commissioner the  recovery notice dated 16.1.2007  shall be kept in abeyance. However, it will  be open for the respondent  to proceed and pass appropriate order in accordance with law.

With the above observations the writ petition  is disposed of.
