Heard counsel for the petitioner.
By this writ petition the petitioner h as prayed for quashing the order dated 22.1.2007 passed by the Commissioner by which the appeal filed by the respondent no. 4 has been admitted and the interim order has been granted. Learned counsel for the petitioner contended that he had filed caveat in the appeal but he was not heard. He submits that after the order he has filed an application before the Commissioner which is pending. The order impugned being only interlocutory order granting interim order. It is open for the petitioner to pray for vacation of the stay order before the appellate authority after getting himself impleaded. The writ petition having been filed only against an interim order, cannot be entertained at this stage. It is also observed that the appeal shall be disposed of expeditiously.
With the above observation the writ petition is dismissed.
