Heard Sri Raj Kumar Mishra, learned counsel for the applicant and learned AGA for the State and perused the papers.
85 Ghantas are said to have been stolen from the temple of village Imaliya, P.S. Bhareh, District Etawah on 14.12.2006 as per FIR lodged on 16.12.2006. Out of those stolen Gnantas, 9 Ghantas from the possession of the applicant Bhurey @ Vinod and 5 Ghantas from the possession of applicant -accused Chhotey @ Phool Singh were recovered on 30.12.2006.
It is submitted that the FIR of this case was lodged with great delay. It is further submitted that the applicants have been falsely implicated in this case due to enmity and village partybandi.
On the contrary, the bail of the applicant has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances of this case, without expressing any opinion on the merit, the applicants may be granted bail in the case.
Let the applicant Bhurey @ Vinod S/o Lajja Ram @ Mahindra and Chhotey @ Phool Singh s/o Niranjan Lal involved in Case Crime No. 16 of 2006, under section 379/411 IPC, P.S. Bhareh, District Etawah be released on bail on their executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
