Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents.
The petitioner is aggrieved by an order dated 12.2.2007, whereby he has been transferred from Allahabad to Raibarelly. Admittedly, the petitioner has been posted at Allahabad for more than a decade. Earlier also the transfer of the petitioner was stayed on account of pendency of a criminal case against him in district Court Mirzapur. Now after ten years, again the same ground is being pressed for permitting the petitioner to continue at Allahabad till disposal of the criminal case. It cannot be said that the criminal case against the petitioner is because of his duty as Constable/Head Constable. As such, in my view, the petitioner cannot be permitted to continue at one place in perpetuity merely because of pendency of criminal case against him.
This writ petition lacks merit and is, accordingly, dismissed.
