Heard learned counsel for the parties at great length.
One of the arguments of Sri V.K.S.Chaudhary, learned Senior Advocate, is that even if entire allegation mentioned in the election petition is accepted, respondent No.2 cannot get 14 votes. In support of his allegation, he filed Annexure - SRA - I to supplementary rejoinder affidavit, which according to petitioner, was filed by opposite party. Prima facie it appears that there is over writing in the digits used therein and certified copy of this paper is also not available to any of the parties.
In view of the above, this Court is of the view that original record of the case may be perused.
Learned Standing counsel is directed to produce relevant records relating to election in question along with election petition.
List this case on 1.3.2007.
Sri M.N.Singh, learned counsel for the Opposite Party states that re-counting has taken place, but result has not been declared under the interim order passed by this Court. The interim order already passed shall continue to operate till next date of listing.
Copy of this order be supplied by the Registry to Sri P.P.Chaudhary, learned Sanding Counsel free of cost within 24 hours.
