Heard Sri Vivek Kumar Singh, learned counsel for the applicant and learned AGA for the State and perused the papers.
Motor cycle bearing No. UP17-7110 was stolen on 20.10.2006 at about 3.00 p.m. The said motorcycle is alleged to have been recovered from the joint possession of the applicant Yogesh and co-accused Narendra on 07.12.2006.
The main submission made by the learned counsel for the applicant is that no witness of public was called at the time of alleged recovery and false case of recovery of Motorcycle has been concocted by the police. It is further submitted that the applicant is not named in the FIR.
On the contrary, the bail of the applicant has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicants may be granted bail in the case.
Let the applicant Yogesh S/o Layak Ram involved in Case Crime No. 577 of 2006, under section 379/411 IPC, P.S. Baraut, District Baghpat be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
