Heard learned counsel for the applicants and learned A.G.A.
This application has been filed by the applicants, who are five in number, with a prayer to quash the impugned order dated 22.11.2006 passed by the learned Special Judge(D.A.A.)/ Additional Sessions Judge, Etah in S.S.T. No. 109 of 2006 under sections 323,452 and 395 I.P.C. P.S. Sahabar district Etah.
From the perusal of the impugned order dated 22.11.2006, it appears that the learned Magistrate has taken cognizance to summon the applicants to face the trial.
There is no illegality or irregularity in the impugned order. Therefore, the prayer for quashing the impugned order is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicants it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail their bail application shall be considered and disposed of on the same day in accordance with the provisions of law. No coercive steps shall be taken against the applicants for a period of 30 days from today.
With the above direction the application is finally disposed of .
