Objection filed by the State, be taken on record.
Heard learned counsel for the appellants-accused, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the appellants-accused that there is no evidence against the appellants to have committed the murder of the deceased, but to the effect that the appellants called away the deceased and they were seen coming from the site where the dead body of the deceased was found.
Considering the facts and circumstances of the case, but without expressing any opinion on the merit thereon, the appeal is admitted.
The appellants Devendra and Lajja Ram convicted under Section 302 IPC and Section 3 (2) (5) of S.C./S.T. Act in S.T. No.216 of 1993, Police Station Nawabganj, District Farrukhabad shall be released on bail on their furnishing personal bonds of Rs.50,000/- each with two sureties each in the like amount to the satisfaction of the court concerned.
The realisation of 3/4th of the fine imposed upon appellants Devendra and Lajja Ram shall remain stayed during the pendency of their appeal before this Court and the remaining 1/4th fine shall be deposited forthwith.
