The allegation against the petitioner is that he appeared in the Intermediate examination, 1988 as private candidate on the strength of a forged transfer certificate and other certificates. The petitioner claims that he had actually passed his High School examination in the year 1986 and, therefore, for appearing in the Intermediate examination in the year 1988, he did not require to furnish any certificates. The High School certificate and the mark sheet had been enclosed with this writ petition by way of photocopies.
The inquiry on the basis of which the First Information Report has been lodged against the petitioner appears to have been conducted behind the back of the petitioner.
We, therefore, dispose of this writ petition finally by directing that if the petitioner furnishes original certificate and mark sheet of the High School examination of 1986 along with certified copy of this order before the Investigating Officer of case crime No. 11 of 2006 under sections 420/467/468/471 I.P.C., P.S. Sahpau district Hathras, the petitioner will not be arrested unless on verification, the investigating officer finds these documents to be not genuine.
