Heard learned counsel for the petitioners and the learned A.G.A.
All the petitioners are named accused in the First Information Report in which number of government servants have received injuries in the stone pelting. The kind of lawlessness reported in the First Information Report seems to make it undesirable for staying the arrest or quashing the F.I.R.
We, therefore, decline to either quash the F.I.R., or stay the arrest.
However, if the petitioners surrender and apply for bail in case crime No. 87 of 2007 under sections 147/148/332/333/353/504/506/336/307 I.P.C., and 7 Criminal Law Amendment Act, P.S. Sector 58, NOIDA district Gautambudh Nagar, their bail applications will be considered and disposed of by the Courts below expeditiously.
The writ petition is disposed of as above.
