Heard learned counsel for the applicant and learned A.G.A.
This application has been filed by the applicant against the order dated 9.5.2006 whereby the learned Additional Chief Judaical Magistrate, Muzaffarnagar whereby an interim order of maintenance allowance at the rate of Rs. 400/- month has been allowed.
It is contended by the learned counsel for the applicant that O.P, No.2 is not the wife of the applicant, therefore he is not under obligation to maintain O.P. No.2 as such in such circumstances no interim maintenance should be awarded and the impugned order is wholly illegal.
From the perusal of the impugned order it appears that there is no illegality or irregularity in the impugned order, therefore, the prayer for quashing the same is refused.
However, in case the applicant raises any objection before the court concerned, the same shall be considered and disposed of by the court concerned.
With this direction this application is finally disposed of.
