Heard learned counsel for the applicant and learned A.G.A.
This application has been field by the applicant with a prayer that a suitable direction may be issued to the learned Magistrate concerned to accept fresh bail bonds in the added sections also.
The applicant was released on bail under sections 323,504,506 I.P.C. in Case Crime No. 274 of 1990 P.S. Dibai District Bulandshahar but subsequently section 326 has been added.
The applicant was released on bail. The liberty of bail has not been misused. Therefore, the applicant has a right to furnish fresh bail bonds in the added sections also. Therefore, a suitable direction may be issued to the learned Magistrate concerned to accept the fresh bail bonds.
Considering the facts, circumstances of the case and submission made by the learned counsel for the applicant and the learned A.G.A., it is directed that in case the applicant appears before the court concerned within 30 days from today and furnish his bail bonds afresh in the added sections to the satisfaction of the Magistrate concerned, the same shall be accepted. For 30 days for today, no coercive steps shall be taken against the applicants.
With this direction this application is finally disposed of.
