Heard learned counsel for the petitioner and the learned Standing counsel appearing for the respondents. Learned Standing counsel was earlier granted time to obtain instructions in the matter which have been received by him.
Learned counsel for both the parties state that an identical writ petition, being Civil Misc. Writ Petition No. 10626 of 2002, has been allowed by this Court vide Judgment and order dated 15.9.2005. Learned counsel for the parties agree that this writ petition can also be disposed of in terms of the said Judgment.
Accordingly, for the reasons given in the Judgment and Order dted 15.9.2005 passed in writ petition no. 10626 of 2002 and the Judgment and Order dated 6.5.2005 passed by Lucknow Bench of this Court in writ petition no. 5505 of 1999, this writ petition is allowed and the ceiling limit on the payment of dearness allowance as fixed by the Government Order dated 26.8.1999 is quashed and it is directed that the respondents shall pay the same dearness allowance to the work-charged employees of the respective departments as is being paid to regular employees.
This writ petition stands allowed to the extent indicated above. No order as to cost.
