The objection has already been filed by the State in criminal appeal no.692 of 2007 of the co-accused Dinesh.
Heard learned counsel for the appellant-accused, learned A.G.A. for the State and perused the impugned judgment.
It is contended by the learned counsel for the appellant-accused that the first information report does not say that the appellant also caused injuries to the deceased Rajendra @ Pappu, but his complicity was disclosed later on. Therefore, the case of appellant is distinguishable from the case of those, who alleged to have caused injuries to the deceased.
Considering the facts and circumstances of the case, but without expressing any opinion on the merit thereon, the appeal is admitted.
Connect this appeal with criminal appeal no.692 of 2007.
The appellant Poshakee Lal convicted under Section 302/149, 324/149, 148, 147 IPC in S.T. No.173 of 2000, Police Station Shikohabad, District Firozabad shall be released on bail on his furnishing a personal bond of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the court concerned.
The prayer for staying the fine imposed upon the appellant is hereby rejected.
