This application has been filed by the applicant against the order dated 7.2.2007 passed by the Civil Judge(J.D.) Court no. 44, Agra in complaint case no. 148 of 2006 under sections 389 and 482 I.P.C. pending in the court of Judicial Magistrate, Rath Hamirpur whereby the learned Magistrate has taken cognizance and summoned the applicant to face the trial.
From the perusal of the record it appears that the order impugned is not suffering from any illegality or irregularity. Therefore, the prayer for quashing the same is refused.
However, considering the allegations made in the application it is directed that the applicants shall appear in the court concerned within 30 days from today. If they apply for bail, the same shall be disposed of on the same day in accordance with the provisions of law. For a period of 30 days from today no coercive measures shall be taken against them.
With this direction this application is finally disposed of.
