This application has been filed by the applicants, who are six in number, with a prayer to quash the impugned order dated 17.11.2006 in complaint case 1172 of 2006under sections 147,323,506,452 I.P.C. passed by the Additional Judicial Magistrate, Court No. 1 Aligarh
From the perusal of the impugned order dated 17.11.2006, it appears that the learned Magistrate has taken cognizance to summon the applicants to face the trial.
There is no illegality or irregularity in the impugned order. Therefore, the prayer for quashing the impugned order is refused.
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicants it is directed that in case the applicant No. 1,2,3,4, and 6 appear before the court concerned within 30 days from today and apply for bail their bail application shall be considered and disposed of on the same day in accordance with the provisions of law. No coercive steps shall be taken against the applicants for a period of 30 days from today.
So far as respondent no. 5 is concerned her presence is dispensed with till the framing of the charge. Her presence shall be noted through her counsel but she will have to appear on the date fixed for framing of the charge.
With the above direction the application is finally disposed of .
