Heard learned counsel for the parties and perused the record.
The petitioner being belonging to Backward Category claims promotion on the post of a clerk in the Allahabad Development Authority, Allahabad that by virtue of completing 13 years of work and having passed Intermediate Examination in the year 1986 he is eligible for promotion as Clerk.
It is alleged that there are two posts of clerks vacant on account of retirements of Sri Farhat Ali and Sri J.P.Dubey but the respondent is reluctant to promote him against any of the two vacant posts of Class III Cadre despite making several representations by him in this regard. He made the last representation on 9.1.2007.
The only prayer of the learned counsel for the petitioner is that the representation of the petitioner dated 9.1.2007 contained in Annexure 3 to the writ petition for his promotion to Class III Cadre may be directed to be decided by the respondent within a time bound period.
The learned counsel for the respondent has no objection to this prayer of the learned counsel for the petitioner.
In the circumstances of the instant case and in view of the fact that the only prayer of the learned counsel for the petitioner is for deciding the representation of the petitioner, the respondent is directed to decide the representation of the petitioner dated 9.1.2007 (Annexure 3 to the writ petition) within six weeks from the date of production of a certified copy of this order before the respondent by the petitioner.
With the aforesaid directions, this writ petition is disposed of. No order as to costs.
