Heard Sri K.P. Pandey learned counsel for the applicant and learned AGA for the State and perused the papers.
One stolen motorcycle bearing No. U.P.80-2418 is said to have been recovered from the accused on 24.01.2007.
Main submission made by learned counsel for the applicant is that it could not be ascertained as to which theft the said motorcycle pertains. Further submission is that no public witness was called at the time of alleged recovery.
On the contrary, the bail of the applicants has been opposed by the learned AGA.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.
Let the applicant Bhura S/o Ramaloo involved in Case Crime No. nil of 2007, under section 41/102 Cr.P.C. and 411 IPC, P.S. Govind Nagar, District Mathura be released on bail on his executing a personal bond of Rs. 20000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
