Heard Sri V.K. Baranwal learned counsel for the applicant and learned AGA for the State and perused the papers.
The applicant and co-accused Samsuddin and Badruddin are alleged to have kidnapped Mansoor Alam husband of the complainant Smt. Rehana Khatun.
The main submission made by the learned counsel for the applicant is that the co-accused Samsuddin and Badruddin have been granted bail by the trial court vide order dated 19.05.2006 passed in Bail Application No. 452 of 2006 and hence the applicant should also be granted bail in this case now as the role of kidnapping is similar against all the accused. False implication of the applicant due to enmity is also alleged.
Having heard learned counsel for the parties and keeping in view all the facts and circumstances and further having regard to the fact that co-accused Samsuddin and Badruddin have been granted bail by the trial court, without expressing any opinion on the merit, the applicant also may be granted bail in the case.
Let the applicant Hadish Khan S/o Jakir Khan involved in Case Crime No. C-18 of 2003, under section 364 IPC, P.S. Kotwali, District Balia be released on bail on his executing a personal bond of Rs. 25000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
