It is urged that in the absence of any provision for deemed confirmation, a probationer without there being an order of confirmation cannot be held to be confirmed. However, the Hon'ble Single Judge relying on the definition of probationer in the Standing Orders and the definition of workman held that the petitioner-respondent is deemed to have been confirmed. Prima facie a case for admission is made out.
No notice is required to be issued since Sri Rahul Sahai, Advocate, has appeared and accepted notice on behalf of the sole respondent.
List the appeal for hearing at an early date, preferably in the first week of February, 2007 along with the record of the writ petition.
Having heard and having considered the submissions made and looking to the facts of the case, in the meantime, direction for reinstatement of the petitioner-respondent shall remain in abeyance until further orders of this Court.
