Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants are not named in the F.I.R. The allegation against the applicants is that from their possession looted parts of the cycle were recovered. They have made extra judicial confession before the police. The recovery is not supported by any independent witness.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Irfan, Naaz Mohammad and Rakesh Bihari
involved in case crime no. 190 of 2006 under Sections 396,201,412 I.P.C.,P.S. Kharkhuda District Meerut be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
